TEMPORARY AND OCCASIONAL PROVISION OF SERVICES IN THE EUROPEAN UNION
A professional who is legally established in Romania and authorised to practise as a tourist guide may apply to provide services temporarily and occasionally in another EU or EEA country.
Directive 2005/36/EC on the recognition of professional qualifications establishes rules for temporary professional mobility within the European Union. Under this system, a professional may provide services in another Member State from the country in which they are legally established, subject to the declaration and documentary requirements imposed by the destination country.
The competent authority of the destination country may require documents proving:
- lawful establishment in Romania;
- possession of the Romanian professional qualification;
- the right to practise the profession in Romania;
- the absence of any temporary or permanent prohibition from practising;
- professional insurance, where required;
- identity and nationality;
- any additional documentation required by national legislation.
The temporary and occasional nature of the activity is assessed on a case-by-case basis, taking into account its:
- duration;
- frequency;
- regularity;
- continuity.
The temporary service procedure does not constitute permanent professional establishment in the destination country.

PERMANENT RECOGNITION AND RIGHT OF ESTABLISHMENT
Professionals who intend to live and practise permanently in another EU or EEA country may apply for the formal recognition of their Romanian professional qualification.
Directive 2005/36/EC distinguishes between temporary mobility and permanent establishment. The establishment procedure applies to professionals who wish to work on a stable basis in a country other than the country in which their qualification was obtained.
The competent authority of the destination country may examine:
- the level and duration of the Romanian training;
- the content of the professional programme;
- the professional rights obtained in Romania;
- the applicant's professional experience;
- the activities covered by the qualification;
- the requirements applicable to tourist guides in the destination country.
If substantial differences are identified between the Romanian training and the training required in the destination country, the authority may impose a compensatory measure, such as:
- an adaptation period; or
- an aptitude test.
The applicable procedure, documentation and compensatory measures depend on the legislation of the destination country.
Recognition is not automatic. The final decision is issued exclusively by the competent national authority of the country in which the applicant intends to practise.
